Terms of Service

These Terms of Service (“Terms”) govern access to and use of the EngageUSA website and platform (the “Service”), operated by Push Motion LLC. By using the Service you agree to these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

EngageUSA is a member engagement platform for chambers of commerce and member organizations: points programs, leaderboards, events and notifications, referral groups, rewards, forms, and reporting. The features available to you depend on the packages and add-ons your organization subscribes to.

Participant accounts are provisioned by or through a participating organization. You agree to provide accurate information, keep your credentials (including quick-access codes) confidential, and notify us of any unauthorized use. You must be at least 18 years old, or the age of majority where you live, to use the Service.

Organizations subscribe annually at the pricing published on our site or agreed in an order. Fees are charged per organization at a flat rate regardless of member count. Messaging-based packages include a monthly message allowance; additional usage is billed at the published overage rates. Fees are non-refundable except as required by law or expressly agreed in writing.

• Don't misuse the Service — no unlawful content, harassment, spam, or misrepresentation (including logging activities or referrals that didn't happen).
• Don't attempt to probe, disrupt, or gain unauthorized access to the Service or another organization's data.
• Don't resell or white-label the Service without a written agreement with Push Motion LLC.
• Messaging features must be used consistent with applicable communications laws, including honoring opt-outs.

Organizations and participants retain ownership of the content they submit (activity logs, form responses, images, and similar). You grant Push Motion LLC a license to host, process, and display that content as needed to operate the Service — for example, showing your name and points on your organization's leaderboard.

The Service, including its software, design, and branding, is owned by Push Motion LLC and protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service during your organization's subscription. “EngageUSA” and associated marks may not be used without permission.

The Service relies on third-party providers for hosting, email, and text-message delivery. We are not responsible for failures of third-party networks — for example, carrier delivery of text messages.

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Push Motion LLC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

To the fullest extent permitted by law, Push Motion LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim arising from the Service is limited to the fees your organization paid to us in the twelve months before the event giving rise to the claim.

Organizations may end their subscription per their order terms. We may suspend or terminate access for material breach of these Terms. On termination, an organization may request an export of its program data within a reasonable period.

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Georgia.

We may update these Terms as the Service evolves. We will post updates here with a new effective date; material changes will be communicated to participating organizations. Continued use after changes take effect constitutes acceptance.
